New regulation — Décret 741-2026

Sexual violence at work: what every employer must have in place on May 27, 2027

The regulation published in the Gazette officielle on May 27, 2026 applies to every Quebec employer, with no size threshold. It does not ask for a new programme: it asks that every worker receive in writing the information specific to your workplace, that a complaint procedure be available, and that a person be designated to receive complaints.

    Information, procedure, designated person

    Every worker must have received the information in writing; the complaint and reporting procedure must be available at the workplace; a person must be designated to receive complaints.

  3. May 27, 2028

    Training

    Every worker must have received training on preventing sexual violence, repeated every 3 years.

What the regulation requires, section by section

  • S. 2Take into account that sexual violence can happen at the workplace and away from it — at work-related social activities, through technology — and in interactions with a colleague, clients or the employer.
  • S. 3Give every worker, in writing, information adapted to your workplace: the risks identified, the social interactions likely to lead to sexual violence, the measures in your action plan or prevention programme, and the procedure for complaining or reporting.
  • Ss. 7 and 8Provide a procedure setting out the steps for making a complaint or a report and for handling it, make it available at the workplace, and grant the right to be accompanied by a person of one's choice.
  • Ss. 9 and 10Designate a person to receive and handle complaints, who acts impartially and has the required skills; handle every complaint promptly and avoid secondary victimization.
  • Ss. 4 to 6From May 27, 2028: training for every worker, long enough, on six specified topics, given by someone able to identify and analyse these risks, then repeated every 3 years.

Who it applies to

Every employer. The regulation sets no different rule by business size: a three-person shop is covered like a factory. It comes on top of the harassment-prevention policy already required by the Act respecting labour standards (s. 81.19, since 2019) and Loi 42 (since September 27, 2024), which it does not replace.

Why your action plan matters here

The written information must include the measures in your action plan (s. 3, 3°). A business with fewer than 20 workers that already has its plan has done much of the work: what remains is to pull out what concerns violence and harassment, describe the situations specific to your workplace and write the procedure.

Frequently asked questions

Does the regulation apply to a small business?

Yes. It covers every employer and sets no different rule by business size.

Is training required from 2027?

No. The training sections take effect on May 27, 2028. Every worker must then have received it, and receive it again every 3 years. In 2027, it is the written information, the procedure and the designated person.

Is my harassment policy enough?

It remains required, but it does not cover the whole regulation. The regulation also asks for written information given to every worker, adapted to your workplace and including the measures of your action plan, a procedure available at the workplace, and a designated person.

Does CNESST provide a template?

CNESST has announced it will develop tools to support employers before the regulation takes effect. Check its page “Violence à caractère sexuel en milieu de travail”.

How do I show the information was given?

The regulation requires that it be given in writing to every worker. Keeping an acknowledgement-of-receipt page signed by each one is a simple way to be able to show it.
